General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter "GTC") apply to all orders that you as a customer place with LisaMajun (hereinafter "we" or "us") via our online shop lisamajun.com.

By ordering goods through our online shop, you agree to these terms and conditions.

Conclusion of contract:
The presentation of goods in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy" or "Buy Now" button, you submit a binding order for the goods contained in your shopping cart. The purchase agreement is concluded when we accept your order by sending an order confirmation via email.

3. Product descriptions

All product descriptions, images, and technical data in our shop are intended to provide the best possible representation of our handcrafted products. Due to the handcrafted nature of the products, slight variations in color, size, and design may occur. This is not a defect but rather emphasizes the individual character of our products.

4. Prices and payment terms

Prices:
All prices are final prices and include VAT. In addition to the prices shown, we charge shipping costs for delivery, which are displayed on the respective product page and during the ordering process.

Payment methods:
We accept the following payment methods: credit card, PayPal, SEPA direct debit, instant bank transfer, and other payment methods displayed at checkout. Payment processing is handled by our payment service provider.

5. Delivery and Shipping

Delivery area: We deliver worldwide.

Delivery times:
Since our products are handmade and some are made to order, the following processing times apply:

• Standard: 1-6 weeks
• Express: 1-2 weeks (for an additional fee)

Shipping times:

• Germany: 1-2 working days (Deutsche Post Maxibrief Prio, Tracked) - €6.80
• EU: 3-13 working days (DHL International Registered Letter, Tracked) - €9.70
• Worldwide: 20-30 working days (DHL International Registered Letter, Tracked) - €9.90

Customs and import taxes:
For deliveries outside the EU, customs duties and import taxes may apply, which are the responsibility of the buyer. We are not responsible for delays caused by customs clearance.

6. Retention of title

The delivered goods remain our property until full payment has been received.

7. Right of withdrawal for consumers

Important note: As our products are handmade and made to order, there is no right of withdrawal according to § 312g para. 2 no. 1 of the German Civil Code (BGB) for:

• Custom-made products
• Customized or personalized items
• Products manufactured according to customer specifications

For non-customized, in-stock standard items (if offered), the statutory 14-day right of withdrawal applies. You can find the cancellation policy in our separate cancellation policy.

8. Warranty and Guarantee

The statutory warranty rights apply. The warranty period is two years from receipt of the goods.

Claims for defects:
Should the delivered goods have any defects, please contact us immediately at hello@lisamajun.com with the following information:

• Order number
• Photos of the shortage
• Description of the problem

We will investigate the defect and offer an appropriate solution (repair, replacement, price reduction or refund).

9. Liability

We are fully liable for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty by us or our legal representatives or agents.

We are liable for other damages only in the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on which you may regularly rely. In this case, liability is limited to the foreseeable damages typical for this type of contract.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

11. Copyright

All content in our online shop (texts, images, graphics, designs) is protected by copyright. Reproduction, modification, distribution, and any form of use beyond the limits of copyright law require our written consent.

12. Data protection

Information on the processing of your personal data can be found in our privacy policy.

13. Final provisions

Applicable law:
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Place of jurisdiction:
If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business in Berlin.

Severability clause:
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
